My dad thinks I smoke pot, I honestly don't. I do however smoke cigarettes. My brother was saying my dad's going to buy a drug test for me to see if I'm smoking weed. Will nicotine show up on it?
My dad thinks that because he's constantly finding lighters on me -- my fault for not hiding them good enough.


If the test is just for weed then all the test should detect is THC, the active ingredient in weed. Nicotine showing up on a weed test is like a metal detector finding a piece of wood in your pocket.

Are employers allowed to give pre-employment nicotine and pregnancy tests along with drug and alcohol tests?

I am an employer. I am implementing a drug and alcohol testing policy similar to CFR 49 for Commercial Drivers License Holders. None of my employees have CDLs nor are they required to have one for my company. I just use CFR 49 rules as model for how I do drug and alcohol testing as well as yearly DOT medical exams. Everything is more uniform that way.

Anyway, if you are planning on answering my question asking why I want to do this, do not bother answering. I am looking for the answer to this question. The question is am I allowed to give pre-employment and random nicotine and pregnancy testing? The reason for the nicotine is because I wish to not employ smokers. In my state, this is legal. For pregnant women, the reason is because the type of business I run, pregnant women cannot work in. Please do not ask why. Just answer my question. Is it ok and/or legal for me to do these tests?

I understand this may be discrimination. The reason for this has nothing to do with the fact that I do not want to high pregnant women. I honestly do not care if I do. My only problem is pregnant women cannot work for me because being pregnant does not allow them to perform the job functions we require. I have higher women in the past then, having to let them go on leave, sometimes paid leave, for a very long time being I cannot fire them because it is discrimination. I mean, I have a girl I hired that worked for us for 5 weeks then we found out she was pregnant. We put her paid leave. 11 months later, she just had the baby, she is still on paid leave, and not able to return because her doctor says she is having complications from the pregnancy and she should not work at this time. The doctor said may be 3 more months. I know disability come into play somewhere but I hope you understand why I am looking to implementing this.


You probably need to ask a lawyer about this.

First, whatever the correct answer is when you get sued for discrimination - and you will - a defense of "they told me it was OK on Yahoo" will get you laughed out of court.

Second, if you insist on being secretive about the reasons you will need the attorney-client privilege to protect you from being required to answer embarrassing questions about your motives.

And third, I hope it costs a bundle to get the advice on how to circumvent laws and basic morality.

If the test screened for nicotine, then yes, it could assuming you used nicotine in the 24 hours prior to the test.

However, most drug tests only screen for illegal drugs (THC, methamphetamine, heroin, etc). You should be okay.
