If you are chosen to take a random drug test at your job and it comes back positive for drugs, does your employer have to allow you the right to have an independent test done at your own cost before terminating you? The state in question is Oklahoma if that helps.
By the way....I am the employer, not the employee. I was approached by an employee regarding this situation
To answer you "wuttwutt".....why does anyone ask questions here? I am the owner of a small business (22 emplyoees) I contacted a lawyer who said I did have to allow the employee to pay for an independent test but I got a conflicting answer from the Oklahoma Dept. of Labor. I asked the question here to get more opinions on the matter. In the future should I contact you before asking a question here to get your approval?
Drug tests can be influenced or contaminated by other medicine that you take in, other than prohibited drugs. Sometimes the screening test can be falsely positive. This means the test was positive but it is due to an "interfering substance" and not because of the presence of the prohibited drug. You have the right to a more specific confirmatory test. Tell your employer about this. If he will not allow you an independent test then let the confirmatory test be done in the company's lab, it will not matter. At least, there will be no question or doubt about the succeeding result.

I have gotten the job. I start training soon. just wondering if my manager is planning on not giving me a drug test or if he is trying to surprise me. He has said nothing regarding arranging the test. Looking for anyone that knows the policies on this subject and likeliness of actually having to do it. I am getting a cashier position, for most likely minumum wage and already took the interview where he had stated I could be likely to be trained as a manager eventually. He thinks I have great potential, just wondering if it up to his discretion. oh and I only use Marijuana(occasionally), all other drugs other than the occasional coffee or beer are ridiculous unless you have a severe mental disorder. this is driving me nuts since i cant find the friggin drug policy for pre employment at Rite Aid ANYWHERE.

For the drug test do they give you a cup and send you in a room or do you have to urinate in front of them? Do they send it to the lab or do they get the results right away?
You pee in a cup at a urinal in the bathroom. They do a quick test right away then send it off. they don't tell you the results. btw someone is waatching you when you pee but you are in a urinal soo...
I just got hired and have to take a drug test. What is it like taking the drug test, do I have to urinate in the cup in front of someone or is it private. I don't have anything to worry about, I just don't liek the idea of someone watching me do it. Thanks!
I have taken several drug tests in my life and the ONLY time I actually had someone watch me was when I was tested by the military for entrance. Most drug tests go like this... you get there and they ask you some questions, sometimes they will check you over and make sure you aren't hiding anything like a baggie of someone else's pee or something... then they send you into a bathroom while they stand outside. Sometimes they make you crack the door opened, but like I said... the only time I ever had anyone watch was for the military. It's not so bad... as long as you can pee under pressure. Drink lots of water. :)
